- Introduction
Welcome to TuringNext. These Terms and Conditions (“Terms”) govern your access to and use of our website (www.turingnext.com) and any services provided by TuringNext, including but not limited to mobile app development, website development, custom software development, digital marketing, hosting, and domain registration services (collectively, the “Services”).
By accessing our website, engaging with us via email or any other communication channel, or availing any of our Services, you (“Client,” “User,” or “you”) agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or Services.
- Services Offered
TuringNext provides the following services:
- Mobile Application Development (Android, iOS, cross-platform)
- Website Development (static, dynamic, e-commerce, custom web applications)
- Custom Software Development (enterprise solutions, SaaS platforms, ERP/CRM systems)
- Digital Marketing (SEO, social media marketing, paid advertising, content marketing, branding)
- Web Hosting Services
- Domain Registration Services
The scope, deliverables, timelines, and pricing for each engagement will vary based on individual client requirements and will be detailed in a formal Proposal (see Section 3).
- Proposal and Quotation Process
To maintain transparency and ensure accurate scoping of every project, TuringNext follows a structured proposal process:
- Submission of Scope of Work (SOW): The Client must share their project requirements, objectives, and Scope of Work in writing via email to info@turingnext.com. This may include functional requirements, design references, target platforms, timelines, and any other relevant details.
- Review and Clarification: Upon receiving the SOW, our team may reach out via email or call to clarify requirements, ask follow-up questions, or request additional information necessary to prepare an accurate proposal.
- Proposal Preparation: Based on the finalized Scope of Work, TuringNext will prepare a detailed Proposal covering:
- Project scope and deliverables
- Estimated timeline
- Cost breakdown and payment terms
- Technology stack (where applicable)
- Terms specific to the project
- Proposal Delivery: The Proposal will be shared with the Client via email for review.
- Approval and Onboarding: Once the Client reviews and approves the Proposal (via written email confirmation and/or signed agreement, along with any applicable advance payment), the project will be formally initiated.
Note: No project work will commence without a mutually agreed and approved Proposal. Any change in scope after approval will be treated as a Change Request and may affect the timeline and cost, subject to a revised written agreement between both parties.
- Payment Terms
- Payment terms (advance, milestone-based, or full payment) will be specified in the individual Proposal/Agreement for each project.
- Invoices will be raised as per the agreed payment schedule and are payable within the timeframe specified on the invoice.
- Delayed payments may result in suspension of ongoing work, delayed delivery, or additional late fees, as applicable.
- All prices, unless stated otherwise, are exclusive of applicable taxes (GST or other government levies), which will be charged extra as per prevailing rates.
- Hosting and domain registration services are typically billed on an annual or subscription basis and are subject to renewal terms communicated separately.
- Project Timelines
- Estimated timelines will be communicated in the Proposal and are based on the information available at the time of scoping.
- Timelines are subject to change if:
- The Client delays providing necessary content, feedback, approvals, or access credentials.
- There are changes to the agreed scope of work.
- Unforeseen technical challenges arise during development.
- TuringNext will make reasonable efforts to inform the Client of any expected delays in advance.
- Revisions and Change Requests
- Each Proposal will specify the number of revisions/iterations included within the agreed cost.
- Any request beyond the agreed scope or number of revisions will be treated as a Change Request and may incur additional charges and/or extend the project timeline, subject to mutual written agreement.
- Intellectual Property Rights
- Upon full and final payment for a project, ownership of the final deliverables (source code, design files, or other agreed assets) will be transferred to the Client, unless otherwise specified in the Proposal.
- TuringNext retains the right to use any third-party tools, frameworks, libraries, or pre-existing proprietary code/tools used during development; these are not transferred as exclusive Client property unless explicitly agreed.
- TuringNext reserves the right to showcase completed projects (screenshots, case studies, project descriptions) in its portfolio, website, and marketing materials, unless the Client requests confidentiality in writing.
- Any content, branding, or materials provided by the Client remain the property of the Client, and the Client warrants that they have the right to use and share such materials with TuringNext.
- Confidentiality
- TuringNext agrees to keep all Client business information, project details, and proprietary data confidential and will not disclose such information to third parties without the Client’s written consent, except as required by law.
- Both parties may enter into a separate Non-Disclosure Agreement (NDA) upon request, prior to project commencement.
- Hosting and Domain Registration Services
- Domain registration and hosting services provided by TuringNext are subject to the policies of the respective domain registrars and hosting providers, in addition to these Terms.
- The Client is responsible for timely renewal of domain and hosting subscriptions. TuringNext will make reasonable efforts to send renewal reminders but is not liable for service interruption due to non-renewal or delayed payment by the Client.
- TuringNext is not responsible for data loss, downtime, or service interruptions caused by third-party hosting providers, domain registrars, or events beyond its reasonable control.
- Digital Marketing Services Disclaimer
- Digital marketing services (SEO, social media marketing, paid advertising, etc.) are performance-oriented but results (rankings, traffic, leads, conversions) cannot be guaranteed, as they depend on multiple external factors including but not limited to search engine algorithms, market competition, ad platform policies, and industry trends.
- TuringNext will follow ethical, white-hat practices and industry best standards in all digital marketing engagements.
- Client Responsibilities
The Client agrees to:
- Provide accurate, complete, and timely information, content, and access required for project execution.
- Review and approve deliverables within a reasonable/agreed timeframe.
- Make payments as per the agreed schedule in the Proposal/Agreement.
- Ensure they have the legal right to use any content, trademarks, images, or materials shared with TuringNext for use in the project.
- Limitation of Liability
- TuringNext will make every reasonable effort to deliver quality services as per the agreed Proposal. However, TuringNext shall not be held liable for any indirect, incidental, or consequential damages, including loss of profits, data, or business, arising from the use of our Services.
- Our total liability for any claim arising out of a project shall not exceed the total amount paid by the Client for that specific project.
- TuringNext is not responsible for issues arising from third-party services, plugins, APIs, payment gateways, hosting providers, or platforms integrated into the Client’s project.
- Warranty and Support
- Any warranty or post-delivery support period (e.g., bug fixes) will be explicitly mentioned in the individual Proposal.
- Support beyond the agreed warranty period, or for issues arising from Client-side modifications, third-party integrations, or misuse, may be chargeable separately.
- Cancellation and Refund Policy
- Cancellation of an ongoing project by the Client must be communicated in writing via email.
- Any amount paid for work already completed (based on milestones achieved) is non-refundable.
- Refunds, if applicable, will be assessed on a case-by-case basis as per the terms specified in the individual Proposal/Agreement.
- Website Use Terms
- All content on www.turingnext.com, including text, graphics, logos, and design, is the property of TuringNext and protected under applicable intellectual property laws. Unauthorized use, reproduction, or distribution is prohibited.
- We reserve the right to modify, update, or discontinue any part of the website or its content without prior notice.
- Privacy
Any personal or business information shared with TuringNext through the website, email, or during the course of a project will be handled in accordance with our Privacy Policy and used solely for the purpose of communication, proposal preparation, and service delivery.
- Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or Services shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra.
- Changes to Terms
TuringNext reserves the right to update or modify these Terms and Conditions at any time without prior notice. Continued use of our website or Services after any changes constitutes acceptance of the revised Terms.
