- Overview
This Refund and Cancellation Policy (“Policy”) governs all payments made to TuringNext (“we,” “us,” “our,” or “Company”) for Services including mobile app development, website development, custom software development, digital marketing, hosting, and domain registration (“Services”).
By making any payment to TuringNext, engaging our Services, or approving a Proposal, the Client acknowledges and agrees to the terms set out in this Policy. This Policy forms an integral part of our Terms and Conditions and, where applicable, any Proposal or Agreement signed with the Client.
- General Principle
All Services rendered by TuringNext involve dedicated allocation of manpower, time, tools, and resources from the moment a Proposal is approved and/or an advance payment is made. Accordingly, all payments made to TuringNext are generally non-refundable, except in the limited circumstances expressly stated in this Policy. This Policy is designed to protect the operational and commercial interests of TuringNext while ensuring fair treatment of Clients.
- Advance / Booking Payments
- Any advance, booking, or token amount paid by the Client to initiate a project, reserve a project slot, or commence discovery/planning work is strictly non-refundable under any circumstances, including but not limited to a change of mind, change in business plans, or Client-initiated cancellation.
- The advance payment compensates TuringNext for resource planning, team allocation, and project scheduling undertaken immediately upon Client confirmation, regardless of whether development work has visibly commenced.
- Milestone-Based Projects
For projects billed in milestones:
- Payments for any milestone that has been completed, delivered, or substantially worked upon are non-refundable, irrespective of subsequent cancellation by the Client.
- If the Client cancels a project mid-way, TuringNext reserves the right to retain the full payment corresponding to:
- Work already completed, and
- Work-in-progress at the time of cancellation, calculated at TuringNext’s sole discretion based on effort/time expended, and
- A cancellation charge (see Section 7) to cover resource de-allocation and administrative costs.
- Only the amount paid for milestones that have not been started may be considered for refund, entirely at TuringNext’s discretion, and subject to deduction of applicable charges under this Policy.
- Full/Fixed Price Projects
- For projects billed as a single fixed price, once work has commenced (including planning, design, wireframing, or development), no refund shall be issued, regardless of the project completion percentage.
- If the Client requests cancellation before any work has commenced, TuringNext may, at its sole discretion, refund the amount paid after deducting administrative, planning, and processing charges as outlined in Section 7.
- Circumstances Where Refunds Are NOT Applicable
Refunds shall not be provided under any of the following circumstances, including but not limited to:
- Change of mind, change in business priorities, or budget constraints on the Client’s part after work has commenced.
- Delay caused by the Client in providing content, credentials, approvals, feedback, or access required for project execution.
- Client’s failure to respond to communications for an extended period, resulting in project delay or automatic closure.
- Dissatisfaction with deliverables that materially conform to the agreed Scope of Work/Proposal.
- Any Change Requests raised and executed at the Client’s request that fall outside the original Scope of Work.
- Third-party issues, including but not limited to hosting provider outages, domain registrar issues, payment gateway failures, or app store/play store rejections not attributable to TuringNext’s negligence.
- Cancellation of hosting or domain services after activation/registration, as these are governed by the respective third-party provider’s non-refundable policies (see Section 9).
- Any digital marketing engagement where campaigns have been launched, ad spend incurred, or strategy/content delivered, regardless of performance outcomes (see Section 10).
- Force majeure events as described in Section 11.
- Cancellation Charges
If a Client wishes to cancel an ongoing project for any reason, the following shall apply:
- A written cancellation request must be sent to info@turingnext.com.
- TuringNext reserves the right to charge a cancellation fee to cover resource de-allocation, administrative closure, and opportunity costs, in addition to charges for work already completed or in progress.
- Any handover of partial deliverables (source code, design files, etc.) upon cancellation shall only be provided after full settlement of all outstanding dues, including cancellation charges.
- TuringNext reserves the sole right to determine the extent of work completed and the corresponding non-refundable amount, acting reasonably and in good faith.
- Refund Processing
- In the rare event that a refund is approved by TuringNext at its sole discretion, it will be processed within 15–30 business days from the date of written approval.
- Refunds, where applicable, will be made to the original mode of payment only, unless otherwise agreed in writing.
- Any bank charges, currency conversion charges, payment gateway fees, or transaction fees incurred in processing the original payment and/or the refund shall be borne by the Client and deducted from the refundable amount.
- International Clients acknowledge that additional deductions may apply due to currency conversion rates and cross-border transaction charges, which are beyond TuringNext’s control.
- Hosting and Domain Registration Services
- Domain registration fees are strictly non-refundable once a domain has been successfully registered, in accordance with ICANN and registrar policies, as domain registration is a one-time, non-reversible transaction with the registry.
- Hosting fees, once the hosting service has been activated/provisioned, are non-refundable, including in cases of early cancellation, non-usage, or Client-side migration to another provider.
- Renewal charges for hosting/domain services already processed are non-refundable. It is the Client’s responsibility to notify TuringNext in writing at least 15 days prior to the renewal date if they do not wish to renew.
- Digital Marketing Services
- Payments made for digital marketing services (SEO, social media marketing, paid ad campaigns, content marketing, branding, etc.) are non-refundable once strategy development, content creation, or campaign execution has commenced.
- Third-party ad spend (Google Ads, Meta Ads, etc.) paid on behalf of the Client, whether directly or through TuringNext, is non-refundable once spent or committed to the respective ad platform.
- As stated in our Terms and Conditions, digital marketing outcomes (rankings, traffic, leads, conversions) are inherently dependent on external factors and are not guaranteed; accordingly, lack of desired results does not constitute grounds for a refund.
- Force Majeure
TuringNext shall not be liable to provide refunds for delays or non-performance caused by events beyond its reasonable control, including but not limited to natural disasters, pandemics, internet/server outages, government regulations, third-party platform policy changes, power failures, or other force majeure events. In such cases, TuringNext will make reasonable efforts to resume and complete the project rather than issue a refund.
- Chargebacks and Payment Disputes
- Clients agree to contact TuringNext directly at info@turingnext.com to resolve any billing concerns before initiating a chargeback or payment dispute with their bank or payment provider.
- Raising an unauthorized or bad-faith chargeback for Services that have been delivered or are in progress, without prior written communication with TuringNext, shall be treated as a breach of these terms. TuringNext reserves the right to:
- Suspend or terminate ongoing Services immediately, and
- Pursue recovery of the disputed amount along with applicable administrative and legal costs, and
- Withhold all deliverables, source files, and access credentials until the matter is resolved in TuringNext’s favor.
- Deliverable Handover Post-Cancellation
- In case of project cancellation or termination for any reason, TuringNext shall only hand over completed deliverables after all outstanding payments (including cancellation charges, if any) have been cleared in full.
- TuringNext reserves the right to withhold source code, credentials, design files, or any other project assets until full and final settlement is received.
- Sole Discretion Clause
Except where refunds are explicitly stated as applicable in this Policy, all decisions regarding refund eligibility, amount, and processing shall rest at the sole and absolute discretion of TuringNext. Approval of a refund in one instance does not create a precedent or obligation for TuringNext to approve refunds in similar or future instances.
- Amendments to This Policy
TuringNext reserves the right to amend, modify, or update this Refund and Cancellation Policy at any time without prior notice. The revised Policy will be posted on this page with an updated “Last Updated” date. Continued engagement with TuringNext’s Services after such changes constitutes acceptance of the revised Policy. The Policy in effect at the time of Proposal approval shall govern that specific project, unless superseded by a signed Agreement stating otherwise.
- Governing Law
This Policy shall be governed by and interpreted in accordance with the laws of India, and any disputes arising from it shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, regardless of the Client’s location.
