1. Purpose of This Notice

TuringNext is a reputed software development and digital marketing company, working with clients including multinational corporations and established industry players across India and internationally. Our brand name, goodwill, and client relationships are core business assets built over time through consistent, professional service delivery.

This Notice is published to put all individuals, entities, competitors, ex-employees, ex-clients, vendors, and members of the public on formal notice that TuringNext will treat any act of defamation, publication of false or misleading statements, fake reviews, malicious comments, or reputation-damaging conduct against TuringNext, its brand, its employees, or its clients with zero tolerance, and will pursue all available civil, criminal, and regulatory remedies against offenders.


2. Conduct Covered Under This Notice

The following acts, whether committed online or offline, by any individual or entity, shall be treated as actionable defamation, reputational harm, or malicious interference with business, and will invite legal action:

  1. Fake or Fabricated Reviews/Ratings — Posting false, exaggerated, or fabricated reviews or ratings about TuringNext or its Services on Google, social media, review platforms, forums, or any other public platform, without factual basis or genuine engagement with TuringNext.
  2. False Statements and Rumors — Publishing, circulating, or communicating false statements, rumors, or misleading claims about TuringNext’s services, work quality, financial standing, business practices, or client relationships, whether in writing, verbally, via email, social media, messaging platforms, or any other medium.
  3. Defamatory Comments and Posts — Making derogatory, defamatory, or malicious remarks about TuringNext, its founders, employees, or representatives on any public or private platform, including social media, community forums, WhatsApp/Telegram groups, or industry networks.
  4. Impersonation and Misrepresentation — Creating fake profiles, fake websites, fake email IDs, or impersonating TuringNext or its representatives to mislead the public, clients, or vendors.
  5. Client Interference and Poaching via Falsehoods — Making false or disparaging claims to TuringNext’s actual or prospective clients, MNCs, or industry partners with the intent to damage business relationships, divert business, or cause commercial loss.
  6. Unauthorized Use of Brand/IP — Misuse, misrepresentation, or unauthorized use of the TuringNext name, logo, trademark, portfolio, or brand identity in a manner that misleads the public or damages brand reputation.
  7. Malicious Digital Campaigns — Organized or coordinated negative campaigns, including fake complaint threads, mass false reporting, or coordinated negative reviews, aimed at damaging TuringNext’s online reputation, search rankings, or social proof.
  8. Confidential Information Leaks — Unauthorized disclosure of confidential business information, client data, contracts, or internal communications by current or former employees, vendors, or clients, where such disclosure damages TuringNext’s or its clients’ reputation or business interests.
  9. Third-Party Reputational Harm — Any of the above acts that, directly or indirectly, cause reputational or financial harm to TuringNext’s clients (including MNCs and industry partners) as a consequence of their association with TuringNext.

3. Legal Basis for Action

TuringNext reserves the right to initiate legal proceedings against offenders under applicable Indian law, including but not limited to:

  • Civil defamation proceedings for damages under the law of torts.
  • Criminal defamation under Sections 356(1), 356(2), and 356(3) of the Bharatiya Nyaya Sanhita, 2023 (corresponding to Section 499/500 of the erstwhile Indian Penal Code), where applicable.
  • Sections 78 and 79 of the Bharatiya Nyaya Sanhita, 2023 and related provisions concerning criminal intimidation and statements causing public mischief, where applicable.
  • Information Technology Act, 2000 (as amended), including provisions relating to publishing defamatory, false, or malicious information through computer systems and cybercrime.
  • Trademark and Copyright laws for unauthorized use or misrepresentation of TuringNext’s brand, name, or intellectual property.
  • Breach of Contract / Confidentiality / NDA provisions, where the offending party is bound by an agreement with TuringNext (employees, vendors, contractors, or clients).
  • Any other applicable provisions of Indian law, and, where relevant, the laws of the offender’s jurisdiction for international offenders, pursued through appropriate cross-border legal mechanisms.

Note: The applicable legal provisions and remedies are cited here for general informational purposes to place offenders on notice. Actual charges and remedies pursued in any specific case will be determined by TuringNext’s legal counsel based on the facts of that case.


4. Indicative Damages and Legal Costs

TuringNext considers its brand reputation, built over years of service to reputed clients including MNCs and established industries, to be a significant and quantifiable business asset. Damage to this reputation directly impacts revenue, client trust, and future business opportunities — for TuringNext and for the clients associated with it.

Accordingly, in the event of a proven act of defamation or malicious reputational harm as described in Section 2, TuringNext reserves the right to pursue a claim for damages that will typically not be less than INR 10,00,000 (Rupees Ten Lakhs) per instance, in addition to:

  • Costs of litigation and legal proceedings;
  • Costs incurred in reputation remediation, including PR, legal notices, takedown requests, and platform escalations;
  • Loss of business/revenue directly attributable to the defamatory act, where quantifiable;
  • Aggravated or exemplary damages, in cases involving malicious intent, coordinated campaigns, or repeat offenses;
  • Applicable interest on the claimed amount from the date of the offending act until realization.

Important Disclaimer: The above figure is an indicative starting position commonly reflected in legal notices of this nature in India, intended to place offenders on notice of the seriousness with which such conduct will be treated. It is not a fixed, guaranteed, or judicially pre-determined amount. The actual quantum of damages claimed or awarded in any specific case will depend on the nature and severity of the act, provable financial loss, extent of reputational harm, jurisdiction, and will be finally determined by TuringNext’s legal counsel and, where litigated, by the competent court or tribunal.


5. Action Against Offenders

Upon identification of any conduct described in Section 2, TuringNext may, at its sole discretion and without prior warning, take one or more of the following actions:

  1. Issue a formal Legal Notice / Cease and Desist through its legal counsel, demanding immediate takedown of the offending content and a public or private apology, where appropriate.
  2. Initiate takedown requests with the relevant platform (Google, Meta, review sites, hosting providers, domain registrars) for removal of defamatory, fake, or malicious content.
  3. File civil suits for damages and injunctive relief before the competent court.
  4. File criminal complaints with the appropriate police authority or cybercrime cell, where the conduct amounts to a criminal offense.
  5. Pursue contractual remedies, including termination of agreements and recovery of damages, against employees, vendors, contractors, or clients who breach confidentiality or non-disparagement obligations.
  6. Publicly clarify factual inaccuracies through official TuringNext channels, where necessary to protect the interests of the Company and its clients.
  7. Pursue cross-border legal remedies against international offenders, including through applicable treaties, mutual legal assistance mechanisms, or jurisdiction-specific counsel, given TuringNext’s international client base.

TuringNext reserves the right to pursue any combination of the above remedies simultaneously and is not limited to a single course of action.


6. Protection Extends to Clients and Partners

Given that TuringNext works with reputed MNCs and industry clients whose own business and reputation may be affected by defamatory or malicious conduct directed at TuringNext (e.g., false claims that a client’s project was mishandled, data was compromised, or services were substandard), this Notice explicitly extends to cover:

  • Reputational harm to TuringNext’s clients arising from false statements about TuringNext’s work for them;
  • Any attempt to use TuringNext’s name to make false claims against a client, or vice versa;
  • Coordinated efforts to damage the business relationship between TuringNext and its clients through false or malicious means.

TuringNext will actively support and cooperate with affected clients in pursuing joint or independent legal action against offenders in such cases.


7. Genuine Feedback and Grievances Are Welcome

This Notice is not intended to suppress genuine, factual, and good-faith feedback, complaints, or criticism regarding TuringNext’s Services. Clients and members of the public with real concerns are encouraged to raise them directly with us at info@turingnext.com, so that we may address them constructively.

This Notice is specifically directed at false, fabricated, malicious, or bad-faith conduct intended to damage TuringNext’s reputation, brand, or business relationships, as distinguished from honest, factual, and good-faith expression of opinion or grievance.


8. Reporting Defamatory Content

If you become aware of any fake reviews, impersonation, defamatory posts, or malicious content targeting TuringNext or its clients, please report it immediately to:

Please include screenshots, URLs, timestamps, and any other supporting evidence to help us take swift action.


9. No Waiver

Failure or delay by TuringNext in taking action against any instance of defamatory or reputation-damaging conduct shall not be construed as a waiver of its right to take action against that instance or any future instance. TuringNext reserves all rights and remedies available to it under law at all times.


10. Governing Law and Jurisdiction

This Notice, and any legal action arising from conduct described herein, shall be governed by the laws of India. All legal proceedings shall be subject to the exclusive jurisdiction of the competent courts in Pune, Maharashtra, regardless of the offender’s location, without prejudice to TuringNext’s right to pursue remedies in other jurisdictions where the offending conduct occurred or where the offender resides, particularly in cases involving international parties.
